# Kerala High Court Writ Appeal: Time Limit and Procedure

By [**Adv. K J Muhammed Aslam**](https://advaslam.com/profile/) · Advocate, Ernakulam (Bar Council of Kerala)

Published 9 October 2026

A Single Judge’s dismissal or allowance of a writ petition is not the end of the road. Section 5 of the Kerala High Court Act, 1958 provides an intra-court appeal — the writ appeal — to a Division Bench of the same High Court. The window is short, the grounds must show legal error rather than disappointment, and stay must be specifically earned. This guide explains what is appealable, the 30-day clock, the paperbook, and the appeal-versus-review-versus-SLP choice. It is general information, not legal advice.

## What is a writ appeal, and how does it differ from review and SLP?

| Remedy | Forum | Function | Limit |
| --- | --- | --- | --- |
| Writ appeal | Division Bench, Kerala High Court (Section 5, Kerala HC Act) | Re-examination of the Single Judge’s judgment on facts and law | 30 days (Article 117, Limitation Act) |
| Review | Same Single Judge | Correction of error apparent on the face of the record, new and important matter, or any other sufficient reason (Order XLVII CPC applied by analogy) | Prompt filing expected; delay weakens maintainability |
| Special Leave Petition | Supreme Court (Article 136) | Discretionary appellate jurisdiction against the Division Bench judgment | 90 days (60 days where a certificate is refused or a death sentence is involved — Article 133, Limitation Act) |

The writ appeal is the ordinary next step within limitation. A review is narrow — disagreement with reasoning is not an error apparent — and is chosen where a demonstrable mistake or fresh decisive material exists. An SLP follows the Division Bench where the grievance survives; approaching the Supreme Court directly without exhausting the writ appeal invites dismissal on that ground alone. The forum map across all High Court tracks sits in the [Kerala High Court litigation guide](https://advaslam.com/writing/kerala-high-court-litigation-guide/), and the writ fundamentals underneath any appeal are in [when Article 226 is the right remedy](https://advaslam.com/writing/writ-petition-high-court-kerala/).

## Which orders are appealable — and which are not?

Appealable in the ordinary course: final judgments allowing or dismissing writ petitions under Article 226 on merits, including judgments with consequential directions. Commonly held non-appealable: purely interlocutory or procedural directions regulating the progress of the petition, consent orders recording the parties’ agreement, and orders in categories the statute or rules exclude from intra-court appeal.

The appeal memorandum must therefore characterise the impugned order correctly: what right it decided, which finding is perverse or legally erroneous, and why the error matters to the outcome. Grounds that merely repeat the writ pleadings without engaging the judgment’s reasoning fail at admission. Where the adverse order comes from a tribunal or subordinate court rather than a Single Judge in writ jurisdiction, the remedy may instead be a supervisory petition under Article 227 or a statutory appeal — see the companion supervisory jurisdiction position summarised alongside this guide.

## How is the 30-day clock computed, and how strict is delay condonation?

Thirty days run from the date of the judgment, computed under the Limitation Act’s exclusion rules for the time taken to obtain the certified copy. In practice: apply for the certified copy immediately, track the copy-ready date, and file within the balance. Delay condonation under Section 5 of the Limitation Act requires sufficient cause specifically pleaded day-by-day and supported by affidavit — medical records, counsel-change correspondence, or documented registry events — not a general apology. The Division Bench examines delay strictly where third-party rights have crystallised on the judgment, as in appointments and tenders.

## What paperbook and prayers does the appeal need?

1. **Memorandum of writ appeal** — parties, chronological facts, the Single Judge’s findings in sequence, and numbered grounds showing perversity, jurisdictional error, or misapplication of law.
2. **Certified copy of the impugned judgment** with the full writ paperbook and exhibits.
3. **Delay application with affidavit** where any part of the 30 days has run, with day-wise explanation and proof.
4. **Stay or status-quo application** — prima facie case, balance of convenience, and irreparable prejudice during appeal, with the specific restraint sought.
5. **Verification and service** — affidavit support and service as per the Registry’s requirements.

Check the current court fee for writ appeals under the Kerala Court Fees and Suits Valuation Act schedule (fixed fees in Schedule II were revised from 1 April 2025), the e-filing fields, and the defect-cure periods under the Kerala High Court Rules before filing.

## How do I get a stay during the appeal?

Stay is never automatic. The application should identify precisely what must be restrained — demolition, termination effect, appointment consequence, recovery steps, or account operation — and why damages or later reversal cannot repair compliance in the interim. Where the Single Judge granted interim protection that operated until judgment, a bridging prayer preserving the position until the Division Bench hears the stay application is standard practice. Advance service on the Government Pleader before moving against the State remains the expected courtesy.

## When should the appeal instead be a review or an SLP?

Choose review where the judgment contains a demonstrable error apparent — a cited provision that does not exist, arithmetic in consequence, a binding precedent overlooked that directly governs — or where decisive new material, unavailable despite diligence, has emerged. Choose SLP where the Division Bench has ruled and a substantial question of law or grave injustice persists, within 90 days (60 days where a certificate of fitness was refused or a death sentence is involved). Choosing neither while limitation runs extinguishes both: calendar the 30-day appeal date on the day of judgment and decide the review question within it.

FAQ

## Common questions

**What is the time limit for filing a writ appeal in Kerala?**

Thirty days from the Single Judge's judgment, under Article 117 of the Limitation Act, 1963, for appeals under Section 5 of the Kerala High Court Act, 1958. Delay is condoned only on sufficient cause specifically pleaded and proved, which the court examines strictly.

**Which Single Judge orders can be challenged in writ appeal?**

Judgments in writ petitions under Article 226 on merits are ordinarily appealable. Purely interlocutory or procedural orders, consent orders, and orders where the statute bars intra-court appeal are the standard exclusions. The appeal memorandum must show the order decides rights, not merely regulates procedure.

**What paperbook does a writ appeal need?**

Certified copy of the impugned judgment, the complete writ pleadings with exhibits, the grounds of appeal showing perversity or legal error (not a mere re-argument), the delay-condonation application with affidavit where applicable, and any stay application with the prejudice it seeks to prevent.

**Should I file a writ appeal, a review, or an SLP?**

A writ appeal re-examines the judgment before a Division Bench and is the ordinary next step within limitation. A review before the same Judge lies only for error apparent, new material, or sufficient reason. An SLP to the Supreme Court under Article 136 follows the Division Bench where the grievance survives, within 90 days — 60 days where the High Court refused a certificate of fitness or a death sentence is involved (Article 133, Limitation Act, 1963).

**Does filing a writ appeal stay the Single Judge's order?**

No — appeal does not operate as automatic stay. Stay or status quo must be specifically prayed for and granted, supported by a showing of prima facie case, balance of convenience, and irreparable prejudice during the appeal.

**What does a writ appeal cost in court process?**

Court fee follows the Kerala Court Fees and Suits Valuation Act schedule for appeals, with fixed fees for writ appeals rather than ad valorem valuation. Confirm the current schedule before filing; advocate fees are a matter of private engagement.
